KENNEDY, Circuit Judge. In this case, defendant Richard Anthony Aloi appeals his convictions for being a felon in possession of a firearm and ammunition in violation of 18 U.S.C. § 922(g)(1). The government cross-appeals the District Court's refusal to sentence defendant under the Armed Career Criminal Act, 18 U.S.C. § 924(e)(1), which would have required a fifteen-year sentence. For the reasons set forth below, we affirm defendant's convictions, but vacate defendant's sentence.
